Аннотация
В статье анализируются причины возникновения, формы проявления и проблемы правового регулирования конфликта интересов при оказании медицинских услуг. Обосновывается, что финансовые, организационные либо личные связи между врачами, медицинскими учреждениями, фармацевтическими компаниями, диагностическими центрами и страховыми организациями могут оказывать негативное влияние на интересы пациента, качество медицинской помощи и профессиональную объективность. В статье раскрывается правовая и этическая сущность конфликта интересов в процессе оказания медицинских услуг. Особое внимание уделяется тому, каким образом финансовая, организационная или личная заинтересованность врача, медицинского учреждения либо фармацевтической компании может повлиять на право пациента на получение качественной, объективной и безопасной медицинской помощи. В научно-теоретическом аспекте рассматриваются основные элементы конфликта интересов: основной интерес, вторичный интерес и противоречие между ними. Кроме того, на основе зарубежного опыта анализируется влияние продвижения лекарственных средств, предоставления подарков врачам, спонсорской поддержки и взаимодействия с представителями фармацевтических компаний на независимость медицинских решений. В статье также рассматриваются существующие правовые основы регулирования конфликта интересов в законодательстве Республики Узбекистан и обосновывается необходимость усиления механизмов раскрытия интересов, внутреннего контроля и юридической ответственности в данной сфере.
