Abstrakt
Mazkur maqolada mahalliy vakillik organlari tomonidan qabul qilinadigan qarorlarning qonuniyligini ta’minlash masalasi davlat boshqaruvi samaradorligi hamda hududlarni barqaror ijtimoiy-iqtisodiy rivojlantirish bilan uzviy bog‘liq institutsional-huquqiy muammo sifatida tahlil qilingan. Mahalliy darajada qaror qabul qilish jarayoni, shuningdek, qarorlarning qonuniyligini ta’minlashga qaratilgan huquqiy, tashkiliy va nazorat mexanizmlari yoritilgan.
Maqolada tizimli, qiyosiy-huquqiy va funksional tahlil usullaridan foydalanilgan holda mahalliy qarorlar qonuniyligini ta’minlashning oldingi, joriy va keyingi nazorat shakllari o‘zaro bog‘liq va kompleks huquqiy mexanizm sifatida o‘rganilgan. Adliya organlari tomonidan amalga oshiriladigan huquqiy ekspertiza, prokuratura nazorati hamda ma’muriy sudlar orqali sudga shikoyat qilish institutining huquqiy tabiati va o‘zaro muvofiqligi ochib berilgan.
Maqolada mahalliy vakillik organlari qarorlarining qonuniyligini ta’minlash, huquqiy ishonchni mustahkamlash, davlat va jamiyat o‘rtasidagi institutsional munosabatlarni barqarorlashtirish hamda hududiy boshqaruv samaradorligini oshirishda muhim ahamiyat kasb etishi asoslab berilgan. Maqolada shakllantirilgan xulosalar mahalliy boshqaruv sohasidagi huquqiy islohotlarni ilmiy asoslash va huquqni qo‘llash amaliyotini takomillashtirish uchun nazariy va amaliy ahamiyatga ega.
