Abstrakt
Ushbu maqolada Incoterms (Xalqaro savdo shartlari) qoidalarining xalqaro xususiy huquqdagi o‘rni va ahamiyati chuqur tahlil qilinadi. Incoterms qoidalari xalqaro savdo bitimlarida tomonlarning majburiyatlari, xarajatlarning taqsimlanishi hamda risklarning o‘tish nuqtalarini aniqlashtirishda muhim vosita sifatida xizmat qiladi. Maqolada Incoterms’ning tarixiy rivojlanishi, 2020-yilgi eng so‘nggi tahriri, ularning amaliyotdagi qo‘llanishi va turli yurisdiktsiyalardagi yuridik kuchi ko‘rib chiqilgan. Xususan, O‘zbekiston misolida ularning amaliy ahamiyati va tatbiqi yoritiladi. Incoterms majburiy huquqiy hujjat bo‘lmasa-da, tomonlar o‘rtasida tuziladigan shartnomalarda ularning aniq keltirilishi natijasida majburiy kuchga ega bo‘lib, xalqaro savdoda huquqiy aniqlik va barqarorlikni ta’minlaydi. Shuningdek, maqolada xalqaro savdo huquqining zamonaviy muammolari — proteksionizm, elektron tijorat, JST islohotlari — ham huquqiy nuqtai nazardan baholangan.
