ELECTRONIC REGISTRATION OF RIGHTS TO REAL ESTATE: PROBLEMS AND WAYS TO SOLVE THEM

Abstract

This article explores in detail the process of implementation and development of electronic registration of real estate rights in the Kyrgyz Republic as a priority direction of the digital transformation of public administration. The author substantiates the thesis that the transition of registration procedures into an electronic format act as a basic guarantee of the stability of civil turnover, allowing to significantly accelerate market processes, minimize administrative costs, and enhance the transparency of interaction between the state, citizens, and business. The paper emphasizes that the effectiveness of the modern digital registration model is determined not only by the technical perfection of portals or mobile applications (such as the Tunduk ecosystem), but also by the fundamental quality of legal regulation. Special attention is paid to a critical analysis of existing problems: the persistence of a “mixed” electronic-paper form, the emergence of digital inequality among the population, as well as risks associated with the inaccuracy of cadastral data and the vulnerability of applicant identification systems. Based on the analysis of international experience and standards (UNECE, the concept of “fit-for-purpose land administration”), the article formulates specific scientific and practical recommendations. A set of measures is proposed for the deep integration of special registration legislation with the Digital Code, securing the legal status of the electronic registration file, and automating interagency data exchange. The author concludes that the creation of a reliable cybersecurity system and the preservation of accessible in-person consulting assistance are necessary conditions for strengthening public trust in digital institutions for the protection of property rights. Such a systematic approach will transform electronic registration from a formal digital copy of the paper process into an independent and high-tech legal mechanism.
